Lens-Only Purchase & Self-Installation Liability Waiver and Release of Claims

Important safety notice: Your 7eye by Panoptx eyewear carries ANSI Z87.1 certification, which is achieved only when lenses are professionally cut and mounted by 7eye technicians using your actual, inspected frame. Frames worn over time may stretch, bend, or otherwise deform, altering the lens groove geometry from factory specifications. Lenses cut to factory dimensions without a physical frame inspection may not seat correctly in an already-worn, used frame.

Why we strongly recommend returning your frame: 7eye's preferred process is for you to ship your frame to their facility, where technicians inspect it, measure your actual lens groove, and cut and mount lenses to achieve full ANSI Z87.1 compliance. By ordering lenses only, you are expressly declining this process and waiving the Z87.1 compliance.

By signing, I knowingly, voluntarily, and with full understanding acknowledge and agree to all of the following:

1. Frame Deformation & Fit Risk. I understand that prolonged wear causes frames to stretch, bend, or warp, changing the lens groove geometry from factory specifications. 7eye cannot verify my frame's condition without physical inspection. Lenses cut to factory specifications may not seat correctly in my deformed frame, which can result in lens failure, dislodgement during use, or serious eye injury.
2. Loss of ANSI Z87.1 Certification. I understand that Z87.1 compliance requires professional manufacturer installation. Self-installation or third-party installation permanently voids Z87.1 certification.
3. Assumption of All Risks. I knowingly and voluntarily assume all risks arising from self-installation, including but not limited to: eye injury or blindness, facial injury, lens dislodgement during motorcycle operation or upon impact, reduced or eliminated impact protection, and related personal injury or property damage.
4. Waiver & Release of Claims. To the fullest extent permitted by California law, I waive, release, and forever discharge 7eye by Panoptx and Heavyglare Eyewear, their parent companies, affiliates, officers, directors, employees, and agents ("Released Parties") from any and all claims, demands, causes of action, and liabilities including personal injury, wrongful death, and property damage arising from the lens-only purchase and self-installation herein.
5. Indemnification. I agree to indemnify, defend, and hold harmless the Released Parties from any and all third-party claims, liabilities, damages, costs, and expenses (including reasonable attorney's fees) arising from my self-installation of lenses.
6. Warranty Void. Self-installation voids all product warranties, express or implied, provided by 7eye by Panoptx.
7. Voluntary & Informed Consent. I confirm I have read and understood this waiver, have had the opportunity to ask questions, and am accepting it freely and without coercion.
8. Minors. If I am under 18, a parent or legal guardian must accept this waiver for me.

This waiver is governed exclusively by the laws of the State of California, without regard to conflict-of-law principles. If any provision is deemed unenforceable, the remaining provisions remain in full force. Nothing herein shall be construed to waive liability for gross negligence or willful misconduct as prohibited under California Civil Code § 1668. The signature I draw and the name I type are my electronic signature; they are saved with my order together with the order number, date, time and IP address.

Waiver of Liability for Ultra Dark and Extra Dark Lenses

By signing, I acknowledge and accept the following:

1. Intended Use: The UltraDark and Photosensitive Extra Dark lenses are specifically designed for medical purposes. These lenses are not suitable for driving, operating machinery, or any activities requiring sharp and unimpaired vision in various lighting conditions.
2. Assumption of Risk: I understand and accept that using these lenses outside their intended purpose may result in impaired visibility, increased risk of accidents, and potential harm. I voluntarily assume all risks associated with their use, including unforeseen risks.
3. Release of Liability: I release and hold harmless 7eye by Panoptx and Heavyglare Eyewear, their officers, employees, agents, and affiliates from any claims, demands, or liabilities related to injuries, damages, or losses arising from the use or misuse of these lenses, including claims based on negligence.
4. Acknowledgment of Instructions: I confirm that I have received, read, and understood all written and verbal instructions regarding the proper use and limitations of the lenses. I agree to follow these instructions and will seek clarification if needed.
5. No Legal Action: I agree not to initiate or participate in any legal action against 7eye by Panoptx or Heavyglare for any claims or disputes arising from the use of these lenses, to the fullest extent permitted by law.
6. Term of Waiver: This waiver is valid for two (2) years from the date of my order and applies to all instances of lens use during this period.

By signing, I confirm that I have read this waiver fully, understand its terms, and agree to be bound by it. I am accepting it voluntarily without any pressure or coercion.
